That would depend on the state where you want to register your business and a few other factors as well.
Usually it would be a good idea to consult an accountant regarding your business plans, however, since today is already December 28th, and this upcoming Monday and Tuesday are holidays, it’s unlikely you could form a new LLC for December 2012 anyway.
