Ownership of DBA

Asked by: John - 24 July, 2012 If I have an existing s corp with another owner and I want to start a new business as a dba under this corp does my partner get ownership of new dba?

Since the DBA would be owned by the S-Corp, technically I would think by default this would make the DBA owned by the other owners as well.

There may be a provision that could be included in the company's bylaws where you could separate the profits (but not liabilities) of the business run under a DBA from the other owners. In this case it would be the best idea to discuss this matter with a licensed business attorney.
