Can an EIN be obtained before LLC is filed?

Asked by: Melanie  — 12 August, 2011

Which comes first, the LLC or the EIN? If the LLC comes first, how long before I can get the EIN and open a business account at my bank?

Dear Melanie,

Technically it is advised to wait until your LLC is formed before the EIN is obtained, for two reasons: you want to make sure that the name you chose is in fact registered and was not rejected (for whatever reason), and secondly, you do want to provide the IRS with the exact date of formation.

As far as opening a bank account most banks would want to see both the EIN letter and some proof of filing (such as a filing receipt or a certified copy of the Articles).
